Purchase of Alcoholic Beverages
Alcoholic beverages may not be sold to anyone under the age of 21. You must be age 21 or older to use this website and/or place an order containing alcoholic beverages. By accessing or using this website, you represent and warrant that you are at least 21 years old.
You represent and warrant to TBS that all items purchased via this website are for personal use and not for resale. You further represent and warrant that you are legally entitled to take possession of the quantities ordered, and that you and the person accepting delivery of the alcoholic beverages are at least 21 years of age.
You are responsible for abiding by all State and local laws, rules, and regulations pertaining to the purchase and receipt of alcoholic beverages in your State. You additionally represent and warrant that you have obtained any required permission, paid any required fees, and are working through properly licensed intermediaries where required.
You understand and acknowledge that you are accountable and liable for compliance with all laws concerning such shipments to your State, and you further agree to indemnify and hold harmless TBS, its thid-party fulfillment partners, agents, officers, directors, shareholders, and employees, from any and all claims, demands, damages, and liability whatsoever, whether in tort, contract, or otherwise, arising out of the shipment of alcoholic beverages to your State, including any and all claims that such shipment may violate any federal, state, or local regulations pertaining to the sale and shipment of alcoholic beverages.
Title to Goods
Laws concerning the sale and shipping of alcoholic beverages are complex and vary from State to State. Accordingly, you will be the legal owner of the goods when your funds have been processed and received, and all or any holds have been cleared. Title to all alcoholic beverages purchased via this website pass to you in the State of Nevada when the goods are transferred to the common carrier.
Appointment of Common Carrier
By making a purchase on this website, you are requesting TBS’ third-party fulfillment partners to appoint a common carrier and arrange transportation on your behalf for the delivery of alcoholic beverages and other merchandise. In so doing, you affirm that you are in compliance with local and State laws regarding the purchase, transportation, and delivery of alcoholic beverages.
Neither TBS nor its third-party fulfillment partners make any representations or warranties concerning the legal requirements of shipping alcoholic beverages to your State. This website may provide a list of States where common carriers have indicated their willingness to deliver alcohol, but it does not guarantee the legality of shipping alcoholic beverages to your State. Any such list of States is subject to change at any time and without notice. You are solely responsible for complying with all laws regarding shipments to your State.
Delivery Requirements
Delivery of orders containing alcoholic beverages must be signed for at the time of delivery by someone over the age of 21. Deliveries will not be left at any address or with any individual without such signature. You are responsible for checking your order immediately upon delivery. Items must be reported as missing or incorrect within three (3) business days from the date of delivery.
Orders cannot be delivered to P.O. Box, military base addresses, or any address outside the United States. It is recommended that you use a business address to receive your shipment.
Failed Delivery
If you fail to receive your shipment after the maximum number of delivery attempts allowed by the common carrier’s policies, and the product is returned, then a 30% restocking fee will be deducted from any refund offered to you. Shipping costs will not be refunded. If the package is returned for refusal of delivery you will be responsible for the full cost of the order.
Shipping & Delivery Timeline
Neither TBS nor its third-party fulfillment partners guarantee any specific shipping or delivery timeline. Orders are processed in the order they are placed and reasonable efforts are made to package and ship orders in a timely manner. Delivery timelines vary by carrier, time of year, and delivery location, and may be subject to weather-related or other delays outside of TBS’ control.
All Sales Are Final
All sales are final, and items ordered and shipped may not be returned or exchanged for any reason. Reasonable precautions are taken to ensure that merchandise is not damaged during shipping. You are responsible for checking your order immediately upon delivery. Items must be reported as damaged, missing or incorrect within three (3) business days from the date of delivery. Such notice must be accompanied by photographs of the item(s) and the packaging. TBS and its fulfillment partners reserve the right, at their sole and exclusive discretion, to refund or replace the affected items.
Limitation of Liability
Neither TBS nor its third-party fulfillment partners will be liable under any legal theory, whether in tort (including negligence), contract, or otherwise, for any incidental, consequential, indirect, special, or punitive damages arising out of your access to or use of this website, regardless of whether TBS or its third-party fulfillment partners have been advised of the possibility of any such damages. TBS RESERVES THE RIGHT TO CHANGE ANY INFORMATION CONTAINED ON THE WEBSITE AT ANY TIME AT ITS SOLE AND ABSOLUTE DISCRETION. IF YOU DO NOT AGREE WITH ANY OF THE TERMS AND CONDITIONS OF THIS WEBSITE, OR ANY CONTENT CONTAINED THEREIN, DO NOT USE THIS WEBSITE. YOUR SOLE AND EXCLUSIVE REMEDY AGAINST TBS OR ITS THIRD-PARTY FULFILLMENT PARTNERS IS TO DISCONTINUE USE OF THE SITE AND DAMAGES AGAINST TBA AND ITS THIRD-PARTY FULFILLMENT PARTNERS SHALL BE LIMITED TO THE DOLLAR VALUE OF THE ORDER PLACED BY YOU.

The information is provided "AS IS" and without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.
Force Majeure
Neither TBS nor its third-party fulfillment partners will be deemed to be in default of or to have breached any provision herein as a result of any delay, failure in performance or interruption of service, resulting from acts of God, acts of civil or military authorities, civil disturbances, wars, strikes or other labor disputes, fires or other catastrophes or occurrences which are beyond TBS’ reasonable control.
Legality & Validity
If any of these terms and conditions (or any portion thereof) or the application of any such provision (or any portion thereof) to any person or circumstance shall be held invalid, illegal or unenforceable in any respect by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect any other provision hereof (or the remaining portion thereof) or the application of such provision to any other persons or circumstances, and the parties shall endeavor to fulfill the intent of the severed provision to the extent permitted by law.
